OBLIGATORY REGULATIONS
FOR NIKOLAYEV SEA COMMERCIAL PORT
1.1.
The Obligatory Regulations for Nikolayev Sea Commercial Port (hereinafter I to
as the Obligatory Regulations) are issued in accordance with Clause 78 of
Merchant Snipping Code of Ukraine.
1.2.
The Obligatory Regulations shall apply to all vessels under all flags located
in the port waters as well as to the enterprises, institutions, organizations
and individuals having their activities on the port territory and in the water
area of Nikolayev Sea Commercial Port (hereinafter referred to as NSCP).
Ignorance of the General Rules and these Obligatory Regulations does not exempt
from responsibility for breach or failure to fulfill the above documents.
In
case of any differencies between the requirements of Regulations of Traffic and
these Obligatory Regulations the latter shall prevail.
1.3.
The Obligatory Regulations shall apply to the water area of NSCP, the port
terminal Ochakov, Galitsynovskiy and Balabanovskiy quarries and approaching
channels to them.
1.4.
Apart from fulfilment of these Obligatory Regulations during navigation in the
water area specified in Clause 1.3, International Regulations for Preventing
Collisions at Sea IRPCS-72), Regulations of Traffic in the
Bugsko-Dneprovsko-Limanskiy Kanal (hereinafter referred to as BDLK) and the
Kherson Sea Channel (hereinafter referred to as KSC) shall be also observed.
1.5.
The water area of NSCP is considered to be the water expanses of the Yuzhny Bug
River limited by the port berth line from the North and the East and by the
line from the West and the South which goes through the following points:
46°56'52", 0N; 31°59'41", 5E; 46°56'48", 5N; 31°59'41", 5E;
46°55'59", 5N; 32°00'52", 0E; 46°56'03", 5N; 32°01'27",5E
including Anchorage 364, the 13th bend of BDLK, the 1st and 2nd bend of the
Nikolayev port channel.
1.6.
The present Obligatory Regulations come into force on "___"__________200_
The
Obligatory Regulations issued in 1997 and corrections to them shall be
considered invalid.
2. DEFINITIONS AND EXPLANATIONS
2.1.
SPSI - State Port Survey Inspection.
2.2.
Turning zone - the turning zone is considered to be 5 cables before and after
the turning buoy.
2.3.
Small - tonnage vessel - a vessel with a full load draft up to 4.0 m.
2.4.
Big vessels - vessels with a full load draft over 4,0 m.
2.5.
Length, breadth, depth - maximum length, breadth, depth.
2.6.
Approach channels - approach channels to Balabanovskiy and Galitsynovskiy
quarries and the port terminal Ochakov.
2.7.
Small vessels - shipping and sport boats and crafts with capacity of engines up
to 150 hp irrespective of the form of ownership.
2.8.
SPSI Station - vessel traffic control station located in the SPSI of NSCP.
3. ENTERING THE PORT AND SAILING FROM THE
PORT
3.1. Arrival of Vessels at the Port, Approach
Information
3.1.1.
All vessels proceeding from the sea or intending to proceed to the sea shall
submit a request containing estimated time of arrival/departure addressed to
the Harbour Master who is the head of the SPSI.
3.1.2.
Traffic in the area to which the Obligatory Regulations apply, is regulated by
the SPSI Station, call sign "Nikolayev - Radio - 5".
3.1.3.
The vessels proceeding to NSCP or passing in transit through its water area
shall inform the SPSI Station about the time of arrival at the port water area
on approaching Konstantinovskiy (the 12th) bend of BDLK, or the 2nd bend of the
Nikolayev port channel proceeding in transit eastwards.
3.2. Calling of Naval Vessels at the Port
3.2.1.
The Harbour Master shall grant a permission to naval vessels to call at and
navigate in the port water area.
The
vessels shall make a proper request not later than 4 hours prior to the arrival
at the port.
3.2.2.
Sailing of the naval vessels and auxiliary vessels from the port shall be
possible only with permission of the Harbour Master which shall be obtained not
later than 1 hour prior to leaving the port.
3.2.3.
The SPSI Station shall be contacted 15 minutes prior to leaving the port in
order to get a permission to do so.
3.2.4.
The naval vessels are granted by the Harbour Master the preferential right to
enter/sail from the port except emergency cases.
NOTICE:
The Harbour Master of NSCP
grants a permission to foreign naval vessels for entering the port and
navigation only in case of fulfillment of the requirements of the Decree of the
Cabinet of Ministers of Ukraine N 529 dated 16 May 1996 "Calling of Foreign
Vessels at Inland Waters, Roads and Ports of Ukraine" which came into
force on 1 July 1996 (NM 1704/97); Zh 1947/55/97.
3.3.1.
Arrival of vessels regardless of their flag and state shall be registered in
the SPSI of NSCP. Foreign vessels shall have their arrival registered through a
supervisor of a marine agency not later than 6 hours after arrival.
3.3.2.
For registration a vessel shall submit documents stipulated by the General
Rules. For the crew's family members a separate list shall be produced as
appendix to a crew list.
3.3.3.
Vessels proceeding to the river port shall inform about their arrival on VHF.
3.3.4.
Vessels calling at the port terminal Galitsynovskiy quarry shall register their
arrival and departure in the SPSI of the terminal.
3.3.5.
River vessels passing in transit through the water area of NSCP shall inform
the SPSI on VHF channel about estimated time of arrival, number of the crew
members, passengers and name of the Master.
3.3.6.
In case of the short - term stay of vessels under loading operations it is
allowed to have departure registered simultaneously with arrival.
3.4. Registration of Departure
3.4.1.
Departure of vessels shall be registered in the SPSI of NSCP. At request of a
vessel the SPSI representative can register the departure on board the vessel.
3.4.2.
For registration of departure from NSCP the Master of a vessel shall submit to
the SPSI, apart from the documents specified in the General Rules, a cargo plan
of deck cargo stowage and calculation of stability at the time of sailing and
arrival to the place of destination.
3.4.3.
Before commencement of loading operations the cargoowner shall provide the
Master of a vessel with cargo declaration in accordance with the requirements
of SOLAS.
3.4.4.
Before sailing from the port the Master shall make in advance a request for
inspection of the vessels by the SPSI control group in accordance with the
procedure of Port State Control (MO Resolution A. 787/19).
Working
hours of the control group are from 08.30 until 17.00 of local time.
3.4.5.
Before registration of departure the Master of newly built vessel shall prepare
a vessel and her crew for inspection with the aim of confirmation her
seaworthiness, and receive in advance the Harbour Master's instructions in
respect of the procedure of sailing from the port.
3.4.6.
A ban of the Harbour Master imposed on a vessel leaving the port and proceeding
to the sea or river, is not limited in time and can only be lifted after
elimination of its causes.
3.4.7.
The services provided by the State Port Survey Inspection, including
registration of the vessels' arrival/departure, control of their compliance
with the International Conventions, shall be paid in accordance with the port
tariff currently in force.
4. NAVIGATION OF VESSELS IN THE PORT WATER
AREA
4.1. General Rules of Navigation
4.1.1.
Vessels proceeding to NSCP or passing in transit through its water area are
allowed to enter the port water area if a vessel's length is up to 215 m and a
freshwater draft is up to 9,8 m except the vessel's proceeding to Berthes 1, 2,
3, 4, 5, 7, 13.
Calling
of vessels with a draft exceeding 9,8 m as well as determination of maximum
draft in respect of Berthes 1, 2, 3, 4, 5, 7, 13 is subject to decision of the Harbour
Master which he shall take in every particular case.
4.1.2.
Navigation of vessels more than 187 m long in the port water area shall be
carried out with tug assistance. Tugs shall be provided at the Master's request
addressed to a port dispatcher. At request of the Master tugs can be also
provided for a vessel with lesser dimensions.
Tugs
provided by the port for assistance shall meet the vessel proceeding to NSCP
when entering BDLK. When sailing from NSCP a vessel shall be assisted by tugs
until leaving BDLK.
4.1.3.
Transit passages of hydrofoil vessels through the water area of NSCP are
allowed during daylight hours only. If visibility is less than 2 miles these
vessels shall proceed in displacement.
4.1.4.
It is prohibited to navigate in the water area of NSCP without assistance for
vessels with a defective anchor or steering gear, and is case of restricted
visibility - with a defective radar station.
4.1.5.
When proceeding through the 13* bend of BDLK and the channel of Nikolayev port
the speed of vessels, except hydrofoil vessels, shall not exceed:
- 12 knots for vessels with
a length up to 170 m and a draft up to 7 m;
- 10 knots for vessels with
a length up to 170 m and a draft from 7 m to 9 m;
- 9 knots for vessels with a
length over 170 m and a draft over 9 m.
Exceeding
of the above speed is allowed only for the sake of prevention of accidents.
4.1.6.
Navigation in the water area of NSCP during fog, haze, snowfall, sea
evaporation, heavy shower and under other conditions when leading beacons or
their lights are not clearly seen as well as with the wind speed exceeding 15
m/sec PROHIBITED.
In
case the above conditions arise when a vessel is in the channel, the vessel
shall proceed with care to the nearest safe place, leave the channel as far as
it is possible and anchor, hi order to hold the vessel in a safe positions or
to turn it when moving the Master shall call a tug.
NOTICE:
The above work is not
considered to be the help to a vessel in distress.
4.1.7.
During navigation in the water area of NSCP anchors of a vessel shall be ready
to be immediately casted, the main engine shall work in maneuverable mode and
radar station and echo sounder shall be switched on.
4.1.8.
Vessels leaving the approach channel shall let the vessels proceeding through
BDLK pass by, unless other instructions are given by a person who grants
permission for entering the channel.
4.1.9
hi cause any mass sport events (regattas, races, cruises) take place in the
port waters, manager of the organization responsible for arrangements shall
inform the Harbour Master not later than 24 hours beforehand about:
- the place and date of the
competitions;
- the kind of aquatic sport
competitions;
- the number and type of
sport vessels;
- the name and positions of
the officials responsible for arrangements;
- water safety means
(vessels, motorboats and so on).
4.1.10.
A vessel shall bear responsibility for damage to fixed navigation guards in
accordance with the prescribed legal procedure.
4.1.11.
It is PROHIBITED to moor to fixed and floating navigation guards.
4.1.12.
Vessels which can not proceed though the channel with the speed more than 4
knots shall notify the "Station" and proceed in tow regardless of the
causes of the said vessel's condition.
Request
for a tug shall be addressed to a dispatcher of the port of destination. Towage
shall be paid in accordance with the tariffs in force.
4.1.13.
One-way traffic shall be organized for proceeding of big-tonnage and difficult
for navigation crafts through the 13th bend of BDLK and the channel of
Nikolayev port. Information about navigation of such crafts shall be given to
the SPSI station of NSCP.
4.1.14.
In case of running aground it is strictly PROHIBITED to refloat without
assistance.
WARNING:
In cause of non-fulfillment
or breach of this Clause of the Obligatory Regulations a shipowner shall incur
all expenses in respect of repair of the channel in the place of collapse of
its edges as well as pay the prescribed penalties. Volume of the works to be
done shall be determined by the divers of NSCP.
4.2. Regulations Concerning Navigation of
Vessels in the Port Waters.
4.2.1.
The order of traffic in the port waters of NSCP is controlled.
4.2.2.
BDLK (the 13* bend of which is included in the water area of NSCP) is the main
channel and navigation in it is regulated by Rule 9 of IRPCS - 72.
4.2.3.
When proceeding through the channel big vessels shall keep the starboard side.
Vessels shall pass each other by their port sides.
4.2.4.
When proceeding through BDLK vessels shall hoist signals seen all over the
horizon:
a) vessels with a draft from
5 up to 8 m: during daylight - black ball, at night - red light located in the
most conspicuous place;
b) vessels with a draft
exceeding 8 m: during daylight - black cylinder, at night - three red lights
located vertically in the most conspicuous place.
4.2.5.
Small tonnage vessels shall let the vessels with the signals specified in
Clause 4.2 4. of these Regulations pass by.
4.2.6.
Vessels with the signals stipulated by Clause 4.2.4. has an advantage over
other big vessels and regulate the order of traffic along the whole length of
BDLK. In case of equal circumstances an outbound vessel has an advantage over
an inbound vessel.
4.2.7.
When proceeding through BDLK vessels without the signals indicated in Clause
4.2.4. shall make way for big vessels.
4.2.8.
All sea and river tug boats both single tugs and tugs in the caravan, as well
as all small - tonnage vessels with full load draft up to 4 m shall proceed
though the channel in both directions when passing by big vessels in the 13
bend of BDLK and in the channel of Nikolayev port.
4.2.9.
All small - dimension, fishing, sport vessels, launches, motor and row boats
shall proceed beyond the channel. They shall cross the channel at right angles
keeping at a proper distance from the vessels proceeding through the channel,
and putting no obstacles in their way.
4.2.10.
When proceeding through the channel vessels shall keep VHF radio station
switched on and tuned to channel 16 (safety channel). Having noticed a vessel
proceeding from the opposite direction they shall stipulate in advance the
order of passing each other.
4.2.11.
When big vessels pass each other in the area of radar visibility of the SPSI
Station the Masters shall follow its recommendations in respect of the place,
speed, etc.
4.2.12.
It is PROHIBITED for one big vessel to overtake the other in the channel,
except cases of prevention accidents. When overtaking manoeuvres of the vessel
shall comply with a good marine practice.
4.2.13.
Vessels which carry out any special works shall take into consideration the
conditions limiting safety of navigation of a big vessel in the channel and
shall take all due measures to ensure its free passage.
4.2.14
Masters of all vessels passing by working dredges shall act strictly in
accordance with the signals given by the dredges.
4.3.1.
Pilotage of all vessels through the water area of NSCP as well as pilotage
during berthing operations in the port and anchoring at the port roads is
compulsory and shall be performed only by state sea pilots of the pilot service
of NSCP.
The
pilot service of NSCP is subordinated directly to the Harbour Master and
located in the SPSI.
4.3.2.
Vessels proceeding to NSCP shall take a pilot on board near Buoy 128 and
pilotage begin after the vessel turns to the 13th bend of BDLK.
Vessels
leaving the port shall take the pilot directly at the berth or at the anchorage
at the port roads.
4.3.3. The vessels with a full load draft up to 5 m
if their Masters regularly sail in BDLK and according to the shipowners'
recommendations have passed examination to the Harbour Master of NSCP and have
got proper certificate, can be exempted from the compulsory pilotage.
4.3.4. The Masters of small - tonnage vessels being
in operation of the organizations (regardless of the form of ownership) which
use for their activities the water area of NSCP, shall pass the examination to
the Harbour Master of NSCP before commencement of navigation in the current
year.
4.3.5. The request for a pilot for piloting a vessel
through the port water area shall be submitted via radio to the Harbour Master
of NSCP through a duty officer of the SPSI 20 minutes prior to approaching of
the vessel to the place where a pilot is taken on board. The request for the
pilot shall include the purpose of piloting (transit passage, mooring to the
port berth, anchoring at the port roads), the main dimensions of the vessel,
fresh water draft, presence of steering devices on board the vessel, etc.
The
request for the pilot for unberthing of the vessel shall be submitted through a
port dispatcher 2 hours prior to commencement of berthing operations. The
pilot, tugs and mooring men shall be sent to the vessel only after the Master
confirms their readiness for berthing operations.
When
weighing anchor at the port roads the pilot shall be requested through the duty
officer of the SPSI 15 minutes prior to weighing anchor provided that the pilot
of the state enterprise "DeIta Pilot" has been taken on board or the
port dispatcher has given instructions in respect of the place of berthing. The
pilot and tugs shall be sent to the vessel only after the Master's confirmation
of readiness for weighing anchor.
4.3.6. Delay of the pilot on board through the fault
of the vessel shall be registered in the pilot's receipt and paid in accordance
with the tariffs in force.
5. STAY OF VESSELS IN THE PORT
5.1. Lying of Vessels at Roads
5.1.1
The water area of Nikolayev port is divided into two anchorages (roads): the
East anchorage and the West one.
5.1.2.
The East anchorage accommodates deep - draft vessels and the West anchorage
-small - tonnage vessels.
By
permission of the SPSI Station vessels with a draft up to 6,5 m can be anchored
at the East anchorage.
5.1.3.
The small - tonnage liquid cargo vessels shall be anchored to the south of the
1st bend of the port channel in the area of light Buoy 130.
5.1.4.
The vessels anchored at the roads shall be provided for connection with the
cost, with an estuary launch working according to its time - table.
5.1.5.
Operation of the vessels' water crafts in the port waters and during their stay
at the roads of NSCP and its port terminal is PROHIBITED.
5.2. Arrangements, Approach to Berthes and
Mooring
5.2.1.
Preparing of cargo berthes for mooring of the vessels shall be performed in
accordance with the instructions of a port dispatcher. Passenger terminals
shall be prepared in accordance with the instructions of a duty officer of the
sea terminal. It shall provide for the following:
a) Free length of the berth
shall be in proportion with the vessel's length and the distance between the
vessels - of 10 to 25 m.
b) Removing of the objects
projecting over the berth borders.
c) Taking gantry cranes out
of the territory of the berth to be prepared. If it is impossible they shall be
located in the middle of the berth (near midship) and turned along the berth.
